TERMS AND CONDITIONS

Thank you for choosing Eardley Education Solutions. These Terms and Conditions ("Terms") govern all educational services provided by Eardley Education Solutions ("we," "our," or "Company") to students and their parents or guardians ("you" or "Client"). By enrolling in our programs, you agree to be bound by these Terms.

1. ENROLLMENT AND SERVICES

1.1 Enrollment Agreement

All clients must complete and sign an Enrollment Agreement before services can begin. The Enrollment Agreement details the specific program, schedule, location, and financial terms.

1.2 Program Recommendations

Our educators provide recommendations for instruction type, duration, and intensity based on professional assessment. These recommendations aim to optimize student progress and outcomes.

1.3 Service Delivery

We deliver educational services as specified in the Enrollment Agreement. All instruction is provided by qualified educators in accordance with our curriculum standards.

1.4 Instruction Hours

The number of instruction hours is specified in your Enrollment Agreement. Completing fewer than the recommended instruction hours may affect expected outcomes. We cannot guarantee the same results if recommended instruction intensity or duration is not completed.

2. PAYMENT TERMS

2.1 Deposit

A non-refundable deposit equal to the first week of instruction (20 hours) is required at signing to secure the student's place in the program.

2.2 Payment Schedule

Remaining balance is due in weekly payments as specified in your Enrollment Agreement. Each payment represents a prepayment for the upcoming week of instruction.

2.3 Late Payments

Payments received after the due date will incur a late fee of $75. Instruction may be suspended until account is brought current.

2.4 Payment Methods

We accept payment via credit card, ACH transfer, or check. A 3% processing fee applies to credit card transactions.

3. CANCELLATION AND ATTENDANCE POLICY

3.1 Cancellation by Client

Sessions canceled with less than 24 hours' notice will be billed at the full rate. Sessions canceled with at least 24 hours' notice may be rescheduled within the program dates, subject to instructor availability.

3.2 Student Absences

No refunds or credits will be provided for student absences or missed sessions. Makeups are offered at our discretion and subject to instructor availability.

3.3 Cancellation by Company

If we must cancel a session, we will provide a makeup session at a mutually agreeable time or credit the client's account for the session.

3.4 Program Withdrawal

Written notice is required for program withdrawal. No refunds will be issued after the refund deadline specified in your Enrollment Agreement. Early withdrawal will result in forfeiture of the non-refundable deposit at minimum.

4. ASSESSMENT AND PROGRESS MONITORING

4.1 Assessments

Pre and post-assessments will be conducted to measure student progress. Additional assessments may be recommended throughout the program.

4.2 Progress Reports

Assessment results will be shared with parents/guardians within 5 business days of completion. Regular progress updates will be provided throughout the program.

4.3 Additional Support

If a student requires additional support beyond the scope of the enrolled program, we will discuss recommendations with parents/guardians.

5. STUDENT BEHAVIOR AND CONDUCT

5.1 Behavior Expectations

Students are expected to:

  • Arrive on time and prepared for instruction

  • Participate actively and respectfully in all activities

  • Complete assigned work and practice

  • Treat educators and peers with respect

  • Follow all safety guidelines and facility rules

5.2 Disruptive Behavior

Persistent disruptive behavior that interferes with instruction may result in:

  • Parent-teacher conference

  • Behavior improvement plan

  • Temporary suspension from program

  • Program termination (in extreme cases)

5.3 Termination for Behavior

We reserve the right to terminate services if a student's behavior consistently disrupts the learning environment or poses a safety risk. In such cases, a prorated refund may be issued for unused prepaid sessions.

6. HEALTH AND SAFETY

6.1 Illness Policy

Students should not attend sessions if they have:

  • Fever within the past 24 hours

  • Vomiting or diarrhea within the past 24 hours

  • Contagious illness (strep throat, pink eye, etc.)

  • Any condition that prevents full participation

6.2 Medication

We do not administer medication to students except in emergency situations (e.g., EpiPen). Please administer all required medications before sessions.

6.3 Allergies and Medical Conditions

Parents/guardians must disclose all allergies and medical conditions on the Enrollment Agreement. We cannot guarantee an allergen-free environment.

7. CONFIDENTIALITY AND PRIVACY

7.1 Student Information

We collect and maintain student information for educational purposes only. All information is kept confidential in accordance with applicable laws.

7.2 Student Records

Parents/guardians have the right to access their child's educational records upon written request.

7.3 Data Security

We implement reasonable security measures to protect student information. Our full Privacy Policy is available on our website.

8. MEDIA RELEASE

8.1 Photo/Video Consent

Unless you opt out in writing, you grant permission for your child to be photographed or recorded during educational activities for internal documentation, marketing materials, and social media.

8.2 Opt-Out Option

Parents may opt out of media release by initialing the designated section on the Enrollment Agreement.

9. INTELLECTUAL PROPERTY

9.1 Materials Copyright

All curricula, materials, and methods provided by Eardley Education Solutions are protected by copyright. Reproduction or distribution without written permission is prohibited.

9.2 Student Work

We may use de-identified student work as examples for educational or marketing purposes unless you opt out in writing.

10. LIABILITY LIMITATION

10.1 Limitation of Liability

Our liability is limited to the amount paid for educational services. We are not liable for incidental, consequential, or special damages arising from our services.

10.2 No Guarantee of Outcomes

While we strive for excellent results, we cannot guarantee specific academic outcomes. Results vary based on student factors including attendance, participation, and completion of recommended practice.

11. DISPUTE RESOLUTION

11.1 Good Faith Resolution

Parties agree to attempt to resolve any disputes in good faith through direct communication before pursuing legal action.

11.2 Mediation

If direct communication fails, parties agree to participate in mediation before a mutually agreed-upon mediator in Miami-Dade County, Florida.

11.3 Governing Law

These Terms are governed by the laws of the State of Florida without regard to its conflict of law principles.

12. MODIFICATIONS TO TERMS

12.1 Updates to Terms

We reserve the right to modify these Terms at any time. Current Terms will always be available on our website, and material changes will be communicated to active clients.

12.2 Continued Enrollment

Continued enrollment after notification of changes constitutes acceptance of the modified Terms.
