TERMS AND CONDITIONS
EFFECTIVE DATE: MAY 1, 2025
Thank you for choosing Eardley Education Solutions. These Terms and Conditions ("Terms") govern all educational services provided by Eardley Education Solutions ("we," "our," or "Company") to students and their parents or guardians ("you" or "Client"). By enrolling in our programs, you agree to be bound by these Terms.
1. ENROLLMENT AND SERVICES
1.1 Enrollment Agreement
All clients must complete and sign an Enrollment Agreement before services can begin. The Enrollment Agreement details the specific program, expected schedule, location, and financial terms.
1.2 Program Recommendations
Our educators provide recommendations for instruction type, duration, and intensity based on professional assessment. These recommendations aim to optimize student progress and outcomes.
1.3 Service Delivery
We deliver educational services as specified in the Enrollment Agreement. All instruction is provided by qualified educators in accordance with our curriculum standards.
1.4 Instruction Hours
The number of instruction hours is specified in your Enrollment Agreement. Completing fewer than the recommended instruction hours may affect expected outcomes. We cannot guarantee the same results if recommended instruction intensity or duration is not completed.
2. PAYMENT TERMS
2.1 Deposit
A non-refundable deposit is required at signing to secure the student's place in the program.
2.2 Payment Schedule
The remaining balance is due in weekly or monthly payments depending on scheduling frequency. Daily students (4 hours or more per week) are billed weekly. Non-daily students (less than 4 hours per week) are billed on a monthly basis. Each payment represents a prepayment for the upcoming week or month of instruction.
2.3 Late Payments
Payments received after the due date will incur a late fee of 10%. Instruction may be suspended until account is brought current.
2.4 Payment Methods
We accept payment via credit card, ACH transfer, or check. A 1.5% convenience fee applies to credit card transactions.
3. CANCELLATION AND ATTENDANCE POLICY
3.1 Cancellation by Client
Sessions canceled with less than 24 hours' notice will be billed at the full rate. Sessions canceled with at least 24 hours' notice may be rescheduled within the program dates, subject to instructor availability.
3.2 Student Absences
No refunds or credits will be provided for student absences or missed sessions. Makeups are offered at our discretion and subject to instructor availability.
3.3 Cancellation by Company
If we must cancel a session, we will provide a makeup session at a mutually agreeable time or credit the client's account for the session.
3.4 Program Withdrawal
Two weeks’ written notice is required for program withdrawal. No refunds will be issued after the refund deadline specified in your Enrollment Agreement. Early withdrawal will result in forfeiture of the non-refundable deposit at minimum.
4. ASSESSMENT AND PROGRESS MONITORING
4.1 Assessments
Pre and post-assessments will be conducted to measure student progress. Additional assessments may be recommended throughout the program. Post-assessments are complimentary when students complete their minimum recommended hours of instruction.
4.2 Progress Reports
Assessment results will be shared with parents/guardians within 5 business days of completion. Regular progress updates will be provided throughout the program.
4.3 Additional Support
If a student requires additional support beyond the scope of the enrolled program, we will discuss recommendations with parents/guardians.
5. STUDENT BEHAVIOR AND CONDUCT
5.1 Behavior Expectations
Students are expected to:

Arrive on time and prepared for instruction

Participate actively and respectfully in all activities

Complete assigned work and practice

Treat educators and peers with respect

Follow all safety guidelines and facility rules
5.2 Disruptive Behavior
Persistent disruptive behavior that interferes with instruction may result in:

Parent-teacher conference
-
Behavior improvement plan
-
Temporary suspension from program
-
Program termination (in extreme cases)
5.3 Termination for Behavior
We reserve the right to terminate services if a student's behavior consistently disrupts the learning environment or poses a safety risk. In such cases, a prorated refund may be issued for unused prepaid sessions.
6. HEALTH AND SAFETY
6.1 Illness Policy
Students should not attend sessions if they have:

Fever within the past 24 hours

Vomiting or diarrhea within the past 24 hours

Contagious illness (strep throat, pink eye, etc.)

Any condition that prevents full participation
6.2 Medication
We do not administer medication to students except in emergency situations (e.g., EpiPen). Please administer all required medications before sessions.
6.3 Allergies and Medical Conditions
Parents/guardians must disclose all allergies and medical conditions at enrollment. We cannot guarantee an allergen-free environment.
7. CONFIDENTIALITY AND PRIVACY
7.1 Student Information
We collect and maintain student information for educational purposes only. All information is kept confidential in accordance with applicable laws.
7.2 Student Records
Parents/guardians have the right to access their child's educational records upon written request.
7.3 Data Security
We implement reasonable security measures to protect student information. Our full Privacy Policy is available on our website.
8. MEDIA RELEASE
8.1 Photo/Video Consent
Permission for your child to be photographed or recorded during educational activities for internal documentation, marketing materials, and social media will be requested in writing from Eardley Education Solutions. Parents reserve the right to opt out.
9. INTELLECTUAL PROPERTY
9.1 Materials Copyright
All curricula, materials, and methods provided by Eardley Education Solutions are protected by copyright. Reproduction or distribution without written permission is prohibited.
9.2 Student Work
We may use de-identified student work as examples for educational or marketing purposes unless you opt out in writing.
10. LIABILITY LIMITATION
10.1 Limitation of Liability
Our liability is limited to the amount paid for educational services. We are not liable for incidental, consequential, or special damages arising from our services.
10.2 No Guarantee of Outcomes
While we strive for excellent results, we cannot guarantee specific academic outcomes. Results vary based on student factors including attendance, participation, and completion of recommended practice.
11. DISPUTE RESOLUTION
11.1 Good Faith Resolution
Parties agree to attempt to resolve any disputes in good faith through direct communication before pursuing legal action.
11.2 Mediation
If direct communication fails, parties agree to participate in mediation before a mutually agreed-upon mediator in Miami-Dade County, Florida.
11.3 Governing Law
These Terms are governed by the laws of the State of Florida without regard to its conflict of law principles.
12. MODIFICATIONS TO TERMS
12.1 Updates to Terms
We reserve the right to modify these Terms at any time. Current Terms will always be available on our website, and material changes will be communicated to active clients.
12.2 Continued Enrollment
Continued enrollment after notification of changes constitutes acceptance of the modified Terms.
13. THE EARDLEY EDUCATION SOLUTIONS FAMILY REFERRAL PROGRAM
The Eardley Education Solutions Family Referral Program is open to active clients and alumni families. A qualifying referral occurs when a new, previously unenrolled family is referred and officially enrolls in an Eardley Education program for a minimum of 20 hours of instruction. Upon qualifying enrollment, the referred family will receive one (1) free welcome session. The referring client will earn free sessions on a progressive tier structure based on the total number of successful, qualifying enrollments: one (1) free session for the 1st referral, two (2) for the 2nd referral, three (3) for the 3rd, four (4) for the 4th, and five (5) for the 5th. Reaching five (5) successful referrals totals fifteen (15) free sessions. Every subsequent referral (6th and beyond) earns the referring client an additional five (5) free sessions each.
All referral rewards unlock exclusively after the referred family formally enrolls in a program meeting the 20-hour minimum requirement. Promotional free sessions earned by the referrer are strictly valid for virtual 1:1 sessions and must be redeemed within 90 days of being earned. Unused sessions will expire after 90 days. Rewards have no cash redemption value, are non-refundable, non-transferable, and cannot be bartered or combined with other promotional offers. Eardley Education Solutions reserves the right to void rewards suspected of fraud, manipulation, or violation of these terms. Eardley Education Solutions retains the right to modify, suspend, or terminate this promotional program at any time, at its sole discretion, without prior notice. Void where prohibited by law.
14. EARDLEY EDUCATION SOLUTIONS LEARNING SKILLS ASSESSMENT RAFFLE (South Alabama Homeschool Expo)
1. Sponsor The sponsor of this promotion is Eardley Education Solutions ("Sponsor").
2. Eligibility This raffle is open only to individuals who are attendees of the South Alabama Homeschool Expo, are at least 18 years of age as of the date of entry, and are the parent or legal guardian of a prospective or current student. Employees of Eardley Education Solutions, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, as well as immediate family members and/or those living in the same household of Employees, are not eligible to participate.
3. Agreement to Rules By participating, the Entrant ("You") agrees to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Eardley Education Solutions as final and binding as it relates to the content of this campaign.
4. Promotion Period Entries will be accepted in person at the South Alabama Homeschool Expo on June 26, 2026 between 10:00am EST and 3:00pm EST.
5. How to Enter The raffle must be entered by submitting an entry using the designated digital form provided by the Eardley Education Solutions booth. To enter, You must agree to sign up for the Eardley Education Solutions email newsletter. The entry must fulfill all campaign requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Eardley Education Solutions. Limit one (1) entry per person/household.
6. Prize The Winner of the campaign (the "Winner") will receive one (1) Learning Skills Assessment. The Approximate Retail Value (ARV) of the prize is $350.00 USD. The specifics of the prize shall be solely determined by Eardley Education Solutions. No cash or other prize substitution shall be permitted. The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner.
7. Odds The odds of winning depend on the number of eligible entries received during the Promotion Period.
8. Winner Selection and Notification Winner will be selected by a random drawing under the supervision of Eardley Education Solutions on or about July 2, 2026. Winner will be notified by the email address provided on the digital entry form within five (5) days following selection of the Winner. Eardley Education Solutions shall have no liability for Winner’s failure to receive notices due to spam, junk email, or other security settings, or for Winner’s provision of incorrect or otherwise non-functioning contact information.
9. Claiming the Prize If the Winner cannot be contacted, is ineligible, fails to claim the prize within ten (10) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected.
10. General Conditions Eardley Education Solutions reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the raffle should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the raffle.
11. Privacy Policy Information submitted with an entry is subject to the Privacy Policy stated on the Eardley Education Solutions website. By entering this raffle, You consent to receiving marketing emails and newsletters from Eardley Education Solutions. You may opt out of these communications at any time by clicking the "unsubscribe" link at the bottom of any email. Opting out after entry will not affect your chances of winning.
15. NICK'S 39TH BIRTHDAY PROMOTION
- Eligibility: This promotion is open to all new and existing clients of Eardley Education Solutions.
- Promotion Period: The 39% discount is valid only on purchases made between Wednesday, June 24, 2026, at 12:00 AM EST and Wednesday, July 1, 2026, at 11:59 PM EST.
- Qualifying Services: The 39% discount applies exclusively to prepaid sessions of Live Virtual Instruction. It does not apply to asynchronous materials, in-person instruction, past due balances, or any other services offered by Eardley Education Solutions unless explicitly stated.
- Payment: Sessions must be paid in full at the time of purchase during the Promotion Period to qualify for the 39% discount.
- No Cash Value: This promotion and the discount have no cash value and cannot be redeemed for any cash value.
- Limitations:
This offer cannot be combined with any other promotions, discounts, or financial aid packages.- The discount cannot be applied retroactively to previously purchased or completed sessions.
- Prepaid discounted sessions are non-transferable and must be used by the designated student.
- Refunds and Cancellations: Standard Eardley Education Solutions cancellation and refund policies apply to all sessions booked using this promotional rate.
- Modification: Eardley Education Solutions reserves the right to modify or terminate this promotion at any time without prior notice, subject to honoring discounts on prepaid sessions already purchased during the promotional window.

ACKNOWLEDGMENT
By signing the Enrollment Agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
